[특보 SR] 사생활의 자유 특보 방한 보고서 SR on the right to privacy's Report of the visit to ROK

UN 사생활의 자유 특별보고관, 조셉 A. 칸나타치 교수는 2019년 7월 15일부터 26일까지 대한민국을 공식 방문하였다. 그는 사생활 보호책의 개선을, 특히 정보기관 및 경찰에 의한 사찰과 관련하여, 긍정적으로 주목하였다. 이에 기존 혹은 신규 정보당국의 권력이 더욱 안착될 수 있도록 국내법을 개혁할 것을 권고했다.

The Special Rapporteur on the right to privacy, Professor Joseph A. Cannataci, carried out an official visit to the Republic of Korea from 15 to 26 July 2019. He noted with satisfaction important improvements in privacy safeguards, especially those regarding surveillance by intelligence agencies and police, and recommends that national law be reformed further to entrench the powers of existing and/or new oversight authorities.

권고안 RECOMMENDATIONS

 사생활 및 정보 보호 

64. … 특보는, 비록 헌법재판소가 해당 사안에 대해 결정을 내리기 전이라도, 정부가 단지 군형법 제92조의6 폐지(관련 수사의 즉각적 중단)만이 아니라 LGBTI 개인들이 폭력과 차별의 공포없이 복무할 수 있도록 국군 구성원에게 성적 다양성과 사생활에 대해 훈련시키는 일에 솔선하여 나설 것을 권고한다. 

… The Rapporteur recommends that, even before the Constitutional Court decides on the issue, the Government should take the initiative, not only to repeal article 92-6 of the Military Criminal Act (and immediately halting all related investigations), but also training members of the Armed Forces on sexual diversity and privacy, so that LGBTI individuals can serve without fear of violence or discrimination.
